4. How and why we use personal information
- (a)
We process personal information for the following purposes, each of which has a lawful basis under POPIA (performance of a contract with you, our legitimate business interests, compliance with a legal obligation, or your consent, as indicated):
- (i)To create and manage your account, and to authenticate you when you sign in — for example by email and password, by an email verification link, or by a one-time code sent by SMS or email (contract).
- (ii)To confirm your eligibility to order age-restricted items such as alcohol, which our delivery drivers verify by checking your ID on delivery (compliance with a legal obligation).
- (iii)To process, allocate, prepare, and deliver your orders, including sharing limited order details with the relevant Restaurant Partner and Driver (contract).
- (iv)To process payments and refunds via PayFast (contract).
- (v)To provide customer support and respond to queries or complaints (contract / legitimate interest).
- (vi)To send order-related communications via SMS (Twilio), email (Resend), and push notification (Firebase), including one-time codes, order status updates, and receipts (contract).
- (vii)To personalise offers and send marketing communications about offers, new restaurants, or promotions — only where you have opted in, and you may opt out at any time (consent).
- (viii)To detect, investigate, and prevent fraud, money laundering and other financial crime, abuse of promotional offers, and security incidents (legitimate interest / legal obligation).
- (ix)To verify the identity of Restaurant Partners and Drivers, and to confirm that the bank account we pay belongs to them, before making payouts — for example by means of a bank confirmation letter, a recent bank statement, or an electronic bank-account verification check (legitimate interest / legal obligation).
- (x)To pay Restaurant Partners and Drivers, and to meet our own tax, accounting, and regulatory obligations, including obligations to SARS (legal obligation).
- (xi)To improve and maintain the Platform, including analysing aggregated, de-identified usage data (legitimate interest).
- (xii)To use the insurance information that a Restaurant Partner or Driver provides only where an incident, claim, or dispute arises — for example, to refer the matter to the relevant party’s insurer and to establish, exercise, or defend a legal claim or responsibility (legitimate interest / establishing or defending a legal right).
- (i)
5. Who we share personal information with
- (a)
We share personal information only as necessary for the purposes described in section 4, with the following categories of recipient:
- (i)Restaurant Partners and Drivers: for an active order only, the assigned Restaurant Partner and Driver receive the information needed to fulfil that order (such as your name, delivery address, and contact number). Drivers’ access to your name, contact number, and address lasts for the active delivery and for up to 20 minutes after the Driver marks the delivery complete, after which it is removed.
- (ii)PayFast: our payment processor, for processing payments and refunds.
- (iii)Supabase Inc. / Supabase entities (database and backend hosting, EU – Ireland region): hosts our application database, including personal information described in section 3. See section 7 for cross-border transfer information.
- (iv)Twilio: for sending one-time codes and order-related text messages by SMS, and for automated phone calls alerting Drivers to new orders.
- (v)Resend: for sending transactional emails (such as receipts and account notifications).
- (vi)Firebase (Google): for delivering push notifications to the Bay Eats app.
- (vii)Professional advisors, auditors, and regulators (including SARS and the Information Regulator), where necessary to comply with our legal obligations or to obtain advice.
- (viii)A prospective buyer or successor, in the event of a sale, merger, or restructuring of Bay Eats’s business, subject to equivalent confidentiality protections.
- (ix)Security personnel of access-controlled estates, complexes, or similar premises in the delivery area: with the relevant Driver’s consent, limited Driver identity details (such as name, ID or passport number, vehicle registration, and driver’s licence details), solely to enable the Driver to access the premises to make a delivery.
- (x)During an active delivery, we share limited details of the assigned Driver with the Customer to enable contact and identification of the delivery — namely the Driver’s first name, vehicle make, model, colour and registration, and a contact number for calling or messaging the Driver via WhatsApp. The Customer’s access to these Driver details is limited to the duration of the active delivery and is removed once the delivery is marked complete.
- (xi)Vercel: hosts the Bay Eats website and the servers that run the Platform, through which personal information passes when you use it.
- (xii)Google Maps Platform (Google): for suggesting, looking up, and checking delivery addresses, and for working out delivery areas and driving distances.
- (i)
- (b)We do not sell personal information to third parties, and we do not share personal information with third parties for their own independent marketing purposes without your consent.
- (c)Restaurant Partners and Drivers may only use personal information shared with them for an order to fulfil that order, and may not use it for their own marketing or retain it beyond what is reasonably necessary, as set out in our agreements with them.
6. Sub-processors and operators
- (a)Supabase, Vercel, PayFast, Twilio, Google Maps Platform, Firebase, and Resend each act as an “operator” on our behalf within the meaning of POPIA, processing personal information only on our instructions and under the protection of their own standard data processing terms, security certifications, and (where applicable) sub-processor lists.
7. Cross-border transfer of personal information
- (a)Our primary application database is hosted by Supabase in the European Union (Ireland region). This means personal information described in section 3 is transferred to, and stored in, a country outside South Africa.
- (b)Section 72 of POPIA permits such a transfer where, among other grounds, the recipient is subject to a law, binding corporate rules, or a binding agreement which provide an adequate level of protection that effectively upholds principles for the reasonable processing of personal information that are substantially similar to POPIA’s conditions.
- (c)We rely on this ground. The European Union’s General Data Protection Regulation (GDPR), which applies to the processing of personal information in Ireland, is widely recognised as providing a level of protection that is substantially similar to, and in some respects more stringent than, POPIA. Supabase’s hosting infrastructure in the EU operates subject to the GDPR and Supabase’s own data processing terms.
- (d)Some of our other operators (Vercel, PayFast, Twilio, Google Maps Platform, Firebase, Resend) may also process or transmit personal information through infrastructure located outside South Africa as part of their standard service delivery. The same assessment applies to those transfers, on the basis of those providers’ own published compliance frameworks (such as GDPR compliance or the EU-US Data Privacy Framework, where applicable).
- (e)If you have questions about cross-border transfers of your personal information, you may contact our Information Officer using the details in section 2.
8. Data retention
- (a)We retain personal information only for as long as necessary for the purposes described in this policy, or as required by law (for example, financial records required by SARS).
- (b)Order data is retained for 1 year following the deletion of your account or your last activity, after which it is anonymised so that it can no longer be used to identify you, save where a longer retention period is required by law (such as tax or accounting records, which we retain for the periods required by the Tax Administration Act and Companies Act).
- (c)Driver identity, licence, and banking information is encrypted and accessible only to authorised administrative users, and is retained for as long as the Driver is active on the Platform and thereafter for the period required by applicable law.
- (d)Even after you delete or close your account, we keep the transaction and financial records relating to your past orders and payments — and, for Restaurant Partners and Drivers, the related identity and bank-account verification records — for the periods required by law (such as tax and company-law records) and to resolve any dispute, chargeback, or investigation. We delete or anonymise the personal information we no longer need.
9. Security
- (a)We implement appropriate technical and organisational measures to protect personal information against loss, unauthorised access, alteration, or disclosure, including: encryption of sensitive information (such as Driver identity numbers and banking details) at the application layer; role-based and row-level access controls so that, for example, Drivers and Restaurant Partners can only access order data relevant to them; and secure transmission of data using industry-standard encryption.
- (b)No system can be guaranteed completely secure. If we become aware of a security compromise that has resulted, or is likely to result, in unauthorised access to or acquisition of personal information, we will notify the Information Regulator and affected individuals as required by section 22 of POPIA.
- (c)Responsible disclosure. If you believe you have found a security vulnerability affecting personal information on the Platform, please report it responsibly to support@bayeats.co.za. Our responsible disclosure approach is set out in our Terms and Conditions.
10. Your rights
- (a)
Subject to POPIA, you have the right to:
- (i)be notified that we hold personal information about you;
- (ii)request access to the personal information we hold about you;
- (iii)request correction or deletion of personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading, or obtained unlawfully;
- (iv)object, on reasonable grounds, to the processing of your personal information;
- (v)withdraw any consent you have given (such as consent to marketing), without affecting the lawfulness of processing before withdrawal; and
- (vi)not be subject solely to a decision based on automated processing which significantly affects you, without an opportunity to make representations.
- (i)
- (b)You can exercise most of these rights directly through your account settings on the Platform, including updating your details and deleting your account. For any other request, contact our Information Officer using the details in section 2. We will respond within the timeframes required by POPIA.
11. Complaints

12. Direct marketing
- (a)We will only send you direct marketing communications (such as promotional WhatsApp messages, emails, or push notifications about offers) if you have opted in. You may opt out at any time by following the unsubscribe instructions in the communication, adjusting your notification preferences in the app, or contacting us directly. Opting out of marketing will not affect transactional communications relating to your orders.
13. Cookies and similar technologies
- (a)The Platform uses cookies and similar technologies necessary for the website and app to function (such as keeping you logged in) and, where applicable, to understand how the Platform is used so that we can improve it.
14. Changes to this policy
- (a)We may update this Privacy Policy from time to time. Material changes will be communicated to you via the Platform or email before they take effect.
